Wish – advertisement placed on our Portal’s www.millionwishesbook.com website. Wish consists of a graphic being a hyperlink to the advertised private (or company) website and a description of User's Wish.

Service – entire functionality of our Portal accessible to all Portal’s Users.

Portal’s User – any person that uses our Portal in any way.

„Wish Hunters” – the team that will participate in our around-the-world trip that promotes the idea of the millionwishesbook.com Portal.

Book of Wishes - Portal’s section comprising of a list of all Wishes registered by our Portal’s Users. Wishes that are placed in our Book of Wishes are assigned by a corresponding country. Book of Wishes consists of many “National Books”.

Wish-Implementing Team – group of people appointed by the Portal’s owner for realization of selected Wishes.

On-line voting – Portal User’s activity consisting of choosing a Wish that is placed in our Book of Wishes and casting a vote on a selected Wish using appropriate hyperlink. The vote becomes valid when the voter types anti-spam code consisting of 2 randomly generated characters and confirms the vote by clicking the proper button. It is possible to vote for only one Wish only once a day (24 hours) using one computer IP address.

Credit - payment to our Portal account available through provided channel within User’s account. Purchasing a credit allows Portal’s User to activate advertisement services within the Portal. One Credit equals 1 EUR (or its equivalent in another currency).

TOP 5 Wishes – Portal’s section, consisting of 5 Wishes of the highest „power“. The power of the Wish is dependent on the number of credits assigned to this Wish. The power of the Wish can be increased at any time by assigning more credits to it and that way making it constantly visible on a high position within the TOP 5 Wishes section (Portal’s main page).

Randomly Chosen Wishes – Portal’s section where there are displayed 5 Wishes, randomly chosen from the Book of Wishes.

Latest Wishes – Portal’s section where there are 5 latest submitted Wishes.

Ranking – Portal’s subpage with the following statistics:

10 Most Popular Wishes (votes) – statistics that takes into account “on-line votes” that have been cast for each Wish by Portal’s Users.

Top Countries – statistics that takes into account the number of Wishes coming from a given country.

Final Wish List – Portal’s section consisting of Wishes chosen for the Final Vote by Portal’s Users.

By registering Portal’s millionwishesbook.com User account, User is obligated to obey closely all the provisions of Portal’s Rules & Regulations.

General Resolutions:

1. User’s Wish will be visible on our Portal’s web site at least 1 year after the Book of Wishes is filled up.
2. Every new Portal’s User has the right to add one free Wish to the Book of Wishes.
3. When free Wish is used each additional Wish costs 1 € or its equivalent in another currency (current exchange rate given on our website will constantly be updated by professional online payment services: Paypal, Moneybookers or dotpay.pl).
4. Advertisement’s graphics used in a Wish have to be static. Their content must comply with the EU law regulations.
5. Once submitted, graphic or Wish cannot be changed.
6. Before submitting the Wish, one should convert graphic into one of the following formats: jpg (.jpeg) .png
7. Graphic can be a hyperlink to a website.
8. Linked website's content has to comply with EU law regulations.
9. Linked website has to be active and NOT under construction.
10. Linked website cannot automatically redirect to another site.
11. All graphics and Wish content is a property of their creator, not a property of millionwisheebook.com Portal.
12. The Portal’s Owner is not responsible for any illegal interference with content of forms transmitted (submitted) by User to the Portal’s server (User Registration, Payment).
13. User‘s account cannot be transferred to third parties.
14. User is obliged to treat all the personal information necessary to log in (passwords and access keys) with strict confidentiality. All the data necessary to log in have to be entered exclusively on pages belonging to the Portal.
15. The terms "all the data necessary to log in" and "passwords and access keys" mean all character sequence (letters, signs, numbers etc.) which are used to authenticate the User and which exclude unauthorized access. The password ought to differ from login and should consist of a combination of both letters and numbers.
16. The User is obliged to protect his/her data used to log in (passwords and access keys) against unauthorized access.
17. In order to use the Portal, User should have a device allowing access to the Internet, as well as software to view its content, accepting cookie files and enabling setting up email account.
18. Portal’s name, graphic appearance, concept of functionality, software and database are covered by copyright laws.

How to become Portal’s Registered User:

1. Procedure of User’s registration and opening User’s account comes after filling up the form accessible at http://millionwishesbook.com/register. Agreement to provide electronic services becomes valid at the time of registration, indefinitely. Right after the registration an automatic “email” message is sent including activation link and all information confirming registering of user’s account.
2. Registration form for User’s Account includes:
   1. Login - User’s name within the Portal. User is identified by other Portal’s Users by Login chosen during registration process.
   2. Password – it is required that password consists of at least 6 alphanumeric characters including at least one number. The form requires typing correct password twice.
   3. Email – it is required to provide correct email address. In order to verify the User an email message will be sent to the registered email address. The form requires typing correct email address twice.
   4. Country – it is required to decide on the country of residence. Wishes added to the Book of Wishes will be registered within database according to the country of residence provided during registration process.
   5. Anti-spam code – it is required to type in 2 randomly generated anti-spam characters for verification (protection from robots).
   6. Confirming the resolutions of Rules & Regulations – in order to complete user’s account registration process it is necessary to accept the resolutions of Rules & Regulations.
3. After completing registration process, user will be granted access to the registered account.

How to add a Wish to the Book of Wishes:

1. In order to add a Wish to the Book of Wishes one has to fill in and submit the user's account registration form.
2. All the necessary information (Help) required to publish the Wish on the Portal as well as information on how to benefit from all other functionalities offered by the Portal is available within user’s account area.
3. Portal’s User has a choice of two kinds of Wishes that one can add to the Book of Wishes:
   1. Wish that is aspiring to the Continental Finale. Realization of the selected Wish within the amount of 50,000 Euro;
   2. Wish that is aspiring to the World Finale – “Grand Finale”. Realization of the selected Wish within the amount of 200,000 Euro.
4. Every User of our Portal has ability to add one free Wish within User’s Account. Each additional Wish placed from the same level of User’s Account costs 1 Euro, regardless of type of Wish.
5. Free Wish is a one aspirinig to the Contintental Finale, realization of which is within the amount of 50,000 Euro.
6. After taking advantage of a free Wish one can add unlimited number of Wishes of any type (50,000 euro, 200,000 euro). In order to do that User account has to be supplied with Credits purchased using one of the provided on-line payment services. Topping up a User account takes place immediately – Portal is fully integrated with on-line payment service providers (Paypal, Moneybookers, Dotpay.pl).
7. Purchase of Credits is based on a pre-paid principle. Adding a paid Wish is preceded by a purchase of a Credit/Credits.
8. One Credit costs 1 EUR (or its equivalent in another currency)
9. Free or paid Wish becomes visible on the Portal immediately after it has been created and confirmed by Portal’s User.
10. To create a Wish one should :
    1. provide the hyperlink to the advertised Web site (not required);
    2. type his/her Wish (required);
    3. upload a banner/ image (not required);
    4. confirm the will to place a Wish in the Book of Wishes.
11. Wish content may refer directly to the account owner as well as it may express the willingness to fulfill somebody else’s Wish.
12. Wish added to the Book of Wishes is automatically assigned to a proper continent and the country of registration. Portal uses the information about the country of residence which is included in the Portal User’s account within which the User adds a Wish.
13. Portal’s User can assign any amount of credits to one particular Wish. It is an additional way to promote a Wish within TOP 5 Wishes section of our Portal. Increasing amount of credits assigned to a particular Wish will increase “the Power” of the Wish, moving it up on the list within TOP 5 Wishes section.
14. Portal’s User, within correctly registered User’s account, is entitled to purchase any number of Credits in order to add any number of Wishes.
15. Portal does not return money for unused Credits.

Wish fulfillment – general resolutions:

1. Our Portal’s goal is to fulfill 7 (seven) Wishes selected from the Book of Wishes by Portal’s Users through on-line voting.
2. Every logged-in Portal’s User has the right to vote.
3. Portal’s User may vote for a chosen Wish contained in the Book of Wishes not more than once daily.
4. Voting for the Wishes placed on our Portal becomes possible from the date of official beginning of “Wish Hunters – Around-the-world” expedition, during the time of expedition and within certain period after its completion.
5. The route of the expedition closely influences the order of voting. The route of “Wish Hunters – Around-the-world” expedition plans to cover 6 continents in the following order (continuous mode): Europe, South America, Central & North America, Oceania & Australia, Asia, Africa, Europe.
6. It is expected to form 7 (seven) Final Lists containing the Wishes chosen for final voting:
   1. Continental Finale “Europe”
   2. Continental Finale “South America”
   3. Continental Finale “Central & North America”
   4. Continental Finale “Oceania & Australia”
   5. Continental Finale “Asia”
   6. Continental Finale “Africa”
   7. World Finale “Grand Finale”
7. Each country has its individual National Book of Wishes. National Books of Wishes from all over the world form collective Book of Wishes.
8. Portal ensures fulfilling only 7 (seven) Wishes chosen in final voting.
9. In case of „ex quo” situation in any of on-line voting, Portal’s owners take into account which Wish has earlier registration date (longer period of presence on the Portal). Time of Wish registration is recorded with the accuracy of one second.
10. The entire cost of Wish realization cannot exceed:
    1. Continental Finale “Europe” – 50,000 euro
    2. Continental Finale “South America” – 50,000 euro
    3. Continental Finale “Central & North America” – 50,000 euro
    4. Continental Finale “Oceania & Australia” – 50,000 euro
    5. Continental Finale “Asia” – 50,000 euro
    6. Continental Finale “Africa” – 50,000 euro
    7. World Finale “Grand Finale” – 200,000 euro
11. Portal’s User, whose Wish was voted for to be fulfilled, agrees to make his/her personal information public on Portal’s website. The User also agrees to fully document implementation of the chosen Wish. Portal secures the right to:
    1. record Wish-Implementation process using all known techniques including printing technologies; reprography; light-sensitive, magnetic, computer, electronic recording and digital technique, on all types of corresponding carries as well as making copies on any carrier using specified techniques;
    2. multiplicate of mentioned documentation on carries, using any techniques specified in point a;
    3. public presentation of all materials documenting Wish-Implementation;
    4. market, bestow, lend originals or copies multiplied on carriers, within European Union and beyond its boundaries;
    5. enter materials to computers’ memory, Internet and multimedia networks, in unlimited amounts of transmissions and quantities of issues;
    6. use in multimedia productions and for marketing, promotional and advertising purposes;
    7. publicly share the materials documenting Wish-Implementation in the way that anybody can access them in suitable place and time.
12. The rights that are mentioned in point 11 are vested to the Portal free of any charge.
13. Actions necessary to fulfill the Wishes that were voted for, will be taken within 60 days starting from the closing date of proper final voting.
14. Implementation of Wishes is brought about by Wish-Implementation Team appointed by Portal.
15. Portal does not pay money being the amount equal to the costs of Wish realization (equivalent). User cannot exchange fulfillment of his/her Wish for financial award.
16. Owner of the Wish that was voted on-line for implementation has 7 (seven) working days to confirm his/her personal information, starting from the date of publishing Wishe’s ID on Portal’s website.
17. Documents confirming identity of the winner have to be sent from email account assigned to the Portal’s User account owner, within which the Wish was registered.
18. In case of situation when Portal’s User, whose Wish was voted for realization, doesn’t meet formal requirements, after 14 days since publishing ID of winner’s Wish, Portal will make another selection of a winning Wish in exchange for the one that was not realized. That will be the next Wish on the list of Final Voting. This principle will be applied until it’s effective.
19. Portal’s User is obliged to enter true personal information during the process of registering Portal’s User account.
20. Portal’s User has to be at least 13 years old. The User that is under 18 years old is obliged to send a written permission to participate in millionwishesbook.com project, signed by a lawful guardian/parent (allowmillionwishesbook.com).

Wish-implementation – Continental Finales:

1. Continental Finale consists of two stages:
   1. preliminary voting which aims to complete the Final List;
   2. voting for Wishes from the Final List during Continental Finale.
2. Final List of Continental Finale consists of the Wishes that received the highest number of votes in the countries that fall under a specific continent (the winners of National Books of Wishes).
3. Final List of Continental Finale is completed solely during the period when the specific continent is “Active”.
4. ”Active Continent” is the one on which the Wish Hunters’ Team is carrying on its “Wish Hunters – Around-the-World” expedition.
5. Final List – relative to specific Continental Finale – contains only the Wishes registered by the Users that are inhabitants of that specific continent.
6. 7 (seven) days after leaving a continent by Wish Hunters’ Team, the Final List for this continent will be closed. At this moment the Final List will be automatically created from the Wishes that has the highest number of votes in the countries of the continent on which the Continental Finale takes place.
7. Maximum 14 days after leaving a continent by Wish Hunters’ Team, Portal will allow the process of on-line voting in order to select Wishes for the Final List of proper Continental Finale.
8. Before one can begin casting votes for a Wish from Final List, all Wishes that participate in the voting will have their counter reset. The votes from preliminary voting will not be added to the number of votes cast on a particular Wish during the Finale.
9. ”Continental Finale” voting lasts full 7 (seven) days (168 hours) counting from its beginning. The Wish that receives the largest number of on-line votes will be selected for realization.

Wish-implementation – „Grand Finale”:

1. World Finale (”Grand Finale”) will take place immediately after completion of “Wish Hunters – Around-the-World” expedition. “Completion of the expedition” means returning of Wish Hunters’ Team to the place of the beginning of the expedition (Main Market Square in Kraków, Poland).
2. ”Grand Finale” consists of two stages:
   1. preliminary voting which aims to complete the Final List;
   2. voting for Wishes from the Final List of “Grand Finale”.
3. Final List – „Grand Finale” – is completed during full 6 (six) weeks since the completion of the “Wish Hunters – Around-the-World” expedition. During this period Portal’s Users from all continents will vote on-line to chose Wishes that received the highest number of votes therefore to select winning Wishes for each continent. These Wishes will form the Final List of “Grand Finale”.
4. Final List of „Grand Finale” consists of the Wishes that received the highest number of votes on each of six continents: Europe, South America, Central & North America, Oceania & Australia, Asia, Africa (according to the results of voting described in point 3).
5. Final List of „Grand Finale” – consists solely of 6 (six) Wishes, one from each continent.
6. Wishes that were chosen for realization during the Continental Finales cannot participate in “Grand Finale”.
7. Voting for the Final List of „Grand Finale” will start immediately after completion of the Final List of “Grand Finale”.
8. Before one can begin casting votes for a Wish from Final List of “Grand Finale”, all Wishes that participate in the voting will have their counter reset. The votes from preliminary voting will not be added to the number of votes cast on a particular Wish during “Grand Finale”.
9. “Grand Finale” voting lasts full 7 (seven) days (168 hours) counting from its beginning. The Wish that receives the largest number of on-line votes will be selected for realization.

Complaint procedure :

1. Complaints of Portal’s User about failing to perform the Service or its inadequate performance should be submitted in the form of e-mail letter and should describe:
   • the User, so that he can be identified,
   • name and type of service which the complaint refers to,
   • point of the complaint,
   • justification of the complaint.
2. The complaint must be sent via the form enclosed on Portal’s website.
3. Portal will investigate the complaint within 14 days since complaint registration which will be followed by the Portal’s response suggesting the solution and explanation of its grounds.

Law regulations:

• The offered advertisement services comply with EU law regulations.
• If Portal’s User does not come under Polish law due to his place of living or is a trader defined by commercial law, any legal disputes will be resolved by court located in the country where the Portal’s Owner has its seat.
• Portal’s owner also has the right to file the lawsuit in the country of the Portal User’s residence.

Final resolutions:

1. Portal’s administrator reserves the right to delete a Wish which breaks resolutions of the Rules & Regulations or binding Law. The cost of placing the Wish will NOT be refunded.
2. Portal is not responsible for any consequences of (losses/damages resulting from):
   • the lack of continuity of services caused by factors beyond Portal’s control,
   • using Portal in an inappropriate way,
   • giving false or incomplete information while registering,
   • violation of resolutions of the Rules & Regulations by Portal’s User,
   • force majeure - natural disasters (flood, hurricane, Earthquake etc.),
   • third party acts and other factors (failures concerning cables, software, hardware, phone operators etc.) beyond Portal’s control and as such not preventable,
   • third party unauthorized use of the User’s authorization data.
3. Portal is responsible for any damage incurred by the User according to the above resolutions of the Rules & Regulations except for the loss of the possible benefits.
4. The User can proceed with legal actions against Portal only after the complaint procedure has been completed.
5. Portal will not refund the payment for the Credit if the information provided by the User proves to be false or point 11 of "General resolutions" is applicable.
6. Millionwishesbook.com Portal is not liable for content of the websites linked within User’s Wish.
7. Portal’s Owner is VAT free (is not payer of VAT).
8. Portal’s Owner reserves the right to introduce changes to the Rules & Regulations. Any changes come into effect 2 days after their publication on the millionwishesbook.com website.
9. Should individual resolutions of the Rules & Regulations become ineffective and/or be in contradiction with the binding law, the remaining resolutions will still be applicable. The resolution legally invalid will be replaced by one agreed upon by both sides. The economic sense and aim of the new resolution will be as close as possible to the replaced one according to the binding law. The above decision applies also to unregulated issues in this document.
10. Content of the present Rules & Regulations constitutes integral entity and it is not allowed to apply individual points of the Rules & Regulations out of context.
